Telework and remote work has become increasingly present in today’s world. With this in mind, the Portuguese Legislator created the temporary stay and residence visas for the “digital nomads”, thus adhering to the trend that was already occurring in Europe. 

These visas are intended for those who carry out a subordinate professional or independent activity, provided remotely to an individual or legal entity domiciled or with its main office outside Portuguese territory was created (article 54/1, line i) and 61-B of Law 23/2007, updated by Law 18/2022 of 25th August). 

Nevertheless, we alert that it is necessary, for the residence visa under these circumstances, that the employment relationship or provision of services is demonstrated.

This amendment to the Foreigners’ Law is still recent, so it is still in the process of implementation.
