Persons falling within the scope of temporary protection

1° Ukrainian nationals who were resident in Ukraine before 24 February 2022.

2° Third country nationals or stateless persons who benefit from international protection or equivalent national protection in Ukraine before 24 February 2022.

3° Third country nationals or stateless persons who establish that they were residing legally in Ukraine “”on the basis of a valid permanent residence permit issued in accordance with Ukrainian law and who are unable to return to their country or region of origin in safe and sustainable conditions

4° Family members of persons mentioned in 1°, 2° and 3° and themselves displaced from Ukraine as of 24 February.

Persons not covered by temporary protection

1° Ukrainian nationals holding a residence permit in France that has expired. They will be invited to go to the prefecture to examine their individual situation.

2° Third country nationals who are able to return to their country of origin in safe and sustainable conditions.

3° Third country nationals from Ukraine whose asylum application was being examined in Ukraine on 24 February.

Formalities

Ukrainians should go to the nearest prefecture and make themselves known as soon as possible.

The prefecture is the authority responsible for organizing reception, official registration, access to rights and accommodation in the territories.

They will obtain a temporary residence permit marked « beneficiary of temporary protection » for a period of 6 months, renewable for up to three years.

Reception & Accomodation

Upon arrival, Ukrainians will be hosted in an emergency reception site for a night or two. Depending on capacity, they will be referred to temporary accommodation until they can find housing. They can benefit from personalized housing assistance.

Right to stay

Beneficiaries of temporary protection are issued with a temporary residence permit for a period of six months, marked “beneficiary of temporary protection”. This permit is renewed automatically for the duration of the validity of the decision of the Council of the European Union activating the temporary protection.

Allowance for temporary protection

Beneficiaries of temporary protection can receive the asylum seeker’s allowance (ADA) for the duration of their protection if they meet age and income requirements. The ADA is paid by the French Office for Immigration and Integration (OFII).

Social Protection

Beneficiaries of temporary protection may, without delay upon arrival in France, be affiliated to the universal health protection scheme and be granted a one-year entitlement to complementary health insurance upon presentation of the temporary residence permit issued under the temporary protection scheme.

Schooling

The Education Code guarantees access to education for all children aged between 3 and 16 years and provides for an obligation of training for children aged between 16 and 18 years present on the national territory.  Beneficiaries of temporary protection under the age of 18 therefore have access to the education system.

Right to work

This temporary residence permit entitles the holder to work. No formality needed.

Family Reunification

A foreigner enjoying temporary protection may apply to be joined

– by a family member who is enjoying temporary protection in another Member State of the European Union;

– by a direct family member not yet present in the territory of the European Union

The following are considered family members, provided that the family already existed in Ukraine before 24 February 2022

– The spouse or partner in a stable relationship

– Unmarried minor children or their spouse’s children, whether or not they were born in wedlock or adopted

– Other close relatives who lived in the family before 24 February 2022 and who were wholly or mainly dependent on a person mentioned in 1°, 2° or 3°
